1. Definitions

System: The online platform operated by Baliwag City PESO for employer onboarding, job posting, applicant screening, interview scheduling, and virtual interviews.
User: Any applicant, employer/recruiter, PESO staff/administrator, or visitor using the System.
Content: Information, files, communications, and materials submitted or displayed on the System.
Employer/Recruiter: A verified organization posting jobs or participating in interviews through PESO.
Applicant: A job seeker registered in the System.

2. Eligibility and Account Use

Users must be of legal working age and have capacity to contract under Philippine law.
Users must provide true, complete, and updated information and promptly correct inaccuracies.
Users are responsible for safeguarding credentials and all activities under their account.
Prohibited conduct includes unlawful, fraudulent, abusive, discriminatory, harassing, exploitative, or misleading behavior; attempting to breach security; scraping or harvesting data; uploading malware; or disrupting service.

3. Platform Role and Recruitment Process

The System connects applicants and employers; PESO does not guarantee employment or outcomes and is not a party to any employment contract.
PESO may verify employer legitimacy (e.g., permits, registrations, PhilJobNet) before job postings go live and may decline or remove postings that fail verification or violate law.
PESO coordinates and approves interview schedules. Employers may request slots, but PESO may accept, modify, or decline based on availability. Applicants must adhere to confirmed schedules.
Users must behave professionally during interviews. Recording or monitoring requires prior disclosure and explicit consent.
Hiring decisions rest solely with employers. PESO facilitates outcome reporting but does not control employer determinations.

4. User Content and Intellectual Property

Users own their uploaded content (e.g., resumes, certificates). By uploading, Users grant PESO a non‑exclusive, royalty‑free license to store, process, and share such content solely for recruitment, compliance, and reporting purposes.
The System’s software, design, branding, and documentation are owned by PESO and/or its licensors. Users may not reverse engineer, copy, frame, or create derivative works without prior written consent.

5. Notifications and Communications

The System may send notifications via in‑app messages and email; SMS may be used where explicitly enabled for specific campaigns.
Users consent to receive transactional messages (e.g., application status, schedules, announcements). Marketing communications require opt‑in and provide opt‑out controls.

6. Third‑Party Services

Virtual interviews may be conducted via integrated services (e.g., Jitsi). Use of third‑party tools is subject to their terms.
The System may rely on third‑party providers for email, hosting, and analytics; availability and performance can be affected by those providers.

7. Availability and Changes

PESO may modify, suspend, or discontinue features with or without notice for maintenance, upgrades, security, or legal compliance.
PESO may update these Terms. Continued use after changes constitutes acceptance.

8. Limitation of Liability and Disclaimers

The System is provided “as is” and “as available.” PESO disclaims warranties of uninterrupted service, error‑free operation, or fitness for a particular purpose.
PESO is not liable for hiring decisions, compensation, workplace issues, or disputes between applicants and employers.
PESO is not liable for indirect, incidental, consequential, punitive, or special damages arising from use of the System.
PESO is not liable for failures due to events beyond reasonable control (e.g., network outages, disasters, acts of government).

9. Suspension and Termination

PESO may suspend or terminate accounts for violations of these Terms, suspected fraud, security risks, or legal requirements.
Users may request account deletion subject to legal, audit, and record‑retention obligations.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines.
Venue shall be the courts of competent jurisdiction in the Province of Bulacan.
Parties are encouraged to seek amicable settlement before litigation.

In compliance with Republic Act No. 10173, also known as the Data Privacy Act of 2012

1. Policy Statement

The Public Employment Service Office (PESO) of the City Government of Baliwag, Bulacan is committed to protecting the privacy and security of all personal information collected from jobseekers, employers, partner agencies, and staff. This policy ensures that all personal data are processed in accordance with the Data Privacy Act of 2012 (RA 10173), its Implementing Rules and Regulations, and related National Privacy Commission (NPC) issuances.

2. Purpose

Ensure responsible and lawful processing of personal information.
Establish clear guidelines on data collection, storage, sharing, and disposal.
Protect individuals’ rights to data privacy and confidentiality.

3. Scope

This policy applies to all personal data processed by PESO Baliwag, whether manually or electronically, and to all personnel, jobseekers, employers, and partner institutions who interact with PESO systems and services.

4. Types of Data Collected

From Jobseekers: Full name, date of birth, contact details, educational background, employment history, skills, and government-issued IDs (e.g., TIN, PhilHealth, SSS).

From Employers and Partners: Company name, address, contact person, job vacancies, and hiring details.

5. Data Processing and Use

Collected data shall be used only for legitimate PESO functions, such as job matching and placement, employment facilitation, DOLE and LGU reporting, and program registration (e.g., SPES, Job Fair, Training). Data shall not be used for commercial purposes or disclosed to unauthorized third parties.

6. Data Protection Measures

Organizational: Designation of a Data Protection Officer (DPO), Privacy Impact Assessments, employee training.
Physical: Secure storage areas, access limited to authorized personnel.
Technical: Password-protected systems, regular backups, antivirus protection, encryption for transfers.

7. Data Retention and Disposal

Personal data shall be retained only as long as necessary for official purposes. After the retention period, records will be securely disposed of or anonymized following NPC guidelines.

8. Rights of Data Subjects

Be informed about how their data are used.
Access and request copies of their personal data.
Correct or update inaccurate information.
Withdraw consent, when applicable.
File a complaint with the National Privacy Commission (NPC).

9. Data Sharing and Disclosure

PESO Baliwag may share data only with DOLE, PhilJobNet, other authorized government databases, and LGU departments for legitimate employment-related functions. All sharing shall be covered by a Data Sharing Agreement (DSA) or Memorandum of Understanding (MOU).

10. Data Breach Management

In the event of a data breach, PESO Baliwag shall immediately investigate, notify the NPC and affected individuals within 72 hours, and implement corrective and preventive measures.
